These Terms of Service ("Terms") govern your use of the Pool Ninjas website (poolninjastn.com) and the Pool Ninjas operations application (together, the "Services"), operated by Pool Ninjas ("Pool Ninjas," "we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
Our website provides information about our pool cleaning, repair, and maintenance services and lets you request a quote. Our operations application is an internal business tool that is restricted to authorized Pool Ninjas staff. It is not a public product and is not offered for use by the general public.
Our operations application connects to Pool Ninjas' own QuickBooks Online company file, and to other business services such as Stripe and Google Workspace, to help us run our business. When we access data through Intuit's QuickBooks Online API, we use that data only for Pool Ninjas' internal operations and reporting, consistent with our Privacy Policy and with Intuit's applicable terms. We do not sell that data or use it for advertising.
You agree not to misuse the Services, including by attempting to access areas or data you are not authorized to access, interfering with normal operation, or using the Services to violate any law. Access to the operations application is limited to authorized users, and you are responsible for keeping your login credentials secure.
The Services, including their content, design, and software, are owned by Pool Ninjas or its licensors and are protected by applicable laws. You may not copy, modify, or distribute any part of the Services without our permission, except as allowed by law.
The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error free, or free of harmful components. Information on the website is for general purposes and does not constitute a binding quote until confirmed by us.
To the fullest extent permitted by law, Pool Ninjas will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Services.
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws rules. Any dispute relating to these Terms or the Services will be subject to the courts located in Tennessee.
We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date above will reflect the most recent revision. Your continued use of the Services after a change means you accept the updated Terms.
